The petitioner seeks bail, who is in custody since 06.09.2021 in connection with S.Tr.No.283 of 2022 (arising out of Mehsi P.S. Case No. 211 of 2021), F.I.R. dated 31.08.2021 registered for the offence punishable under Section 302 of IPC and Section 27 of Arms Act.

Allegation against the petitioner is that he killed his own brother due to family feud.

Learned counsel appearing for the petitioner submits that the petitioner has clean antecedent. He has falsely been implicated in the present case. There is admitted family dispute. Vide order dated 20.03.2023, a report was called for

Patna High Court CR. MISC. No.66423 of 2022(3) dt.12-04-2023 2/2 with regard to the present status of the trial. Report of the learned Trial Court dated 03.04.2023 reveals that out of thirteen prosecution witnesses, twelve witnesses have already been examined and only one witness has yet to be examined in the present case.

Considering the report of the learned Trial Court, I am not inclined to enlarge the petitioner on bail in connection with S.Tr.No.283 of 2022 (arising out of Mehsi P.S. Case No. 211 of 2021) pending in the court of learned Chief Judicial Magistrate, East Champaran at Motihari.

Prayer is refused.

However, the learned Trial Court is directed to expedite the trial and conclude the same at the earliest. (Rajesh Kumar Verma, J) Nitesh/- U T
