The petitioner apprehends his arrest in connection with Lauriya P.S. Case No. 240 of 2016 registered for an offence under Section 414 of the IPC.
The informant who is S.H.O. Lauriya Police Station alleged that on secret information when he along with other police officials reached at the house of one Bhola Mahto, found he was fleeing away along with a stolen Bolero Vehicle. The police seized the Bolero vehicle in presence of witnesses. The apprehended accused Bhola Mahto disclosed that the said vehicle was given by this petitioner.
Learned counsel for the petitioner submits that one
Patna High Court Cr.Misc. No.13252 of 2017 (2) dt.12-04-2017 2/2 Jaiprakash, is the owner of the said Bolero vehicle and he had given the papers and the vehicle to the co-accused Bhola Mahto to drive. The petitioner has no concern with the said vehicle. The name of this petitioner came in alleged confession of Bhola Mahto which has got no evidentiary value.
However, learned APP opposed the submissions. Considering the omnibus allegation of his involvement in the theft of which as also the fact that he has no criminal antecedent, let the above named petitioner in the event of his arrest or surrender in the court below be admitted on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of ACJM, 1st, West Champaran, Bettiah in connection with Lauriya P.S. Case No. 240 of 2016 subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure. (Sanjay Kumar, J) Prakash/- U T
