The petitioner seeks bail in Sessions Trial No. 71 of 2016 arising out of Kanti P.S. Case No. 223 of 2015, instituted for the offences under Section 395/412 of the Indian Penal Code.
Petitioner is in custody since 31.05.2015. The prayer for bail of petitioner has been earlier rejected vide order dated 08.02.2016, and subsequently by order dated 23.08.2017, with direction to the court below to conclude the trial as early as possible preferably within a period of six months after taking the same on priority basis, from the date of receipt/production of a copy of this order.
Patna High Court Cr.Misc. No.61149 of 2018(3) dt.06-11-2018 2/2 A report with regard to stage of the trial has been received in which it is mentioned that not a single witness has been examined in this case. In the written report, there is allegation against petitioner that he was intercepted by the police with a Sumo Victa vehicle. He has confessed his guilt before police.
Learned counsel for the petitioner has submitted that petitioner has no criminal antecedent. He is in custody since 31.05.2015. It has been further submitted that not a single witness has been examined till date in the trial. Considering the aforesaid fact and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge, Muzaffarpur, in connection with Sessions Trial No. 71 of 2016/112 of 2016 arising out of Kanti P.S.
