The petitioners are apprehending their arrest in connection with Bhore P.S.Case No.205/19 registered for offences punishable under Sections 302, 404, 120/B/34 of the Indian Penal Code.

As per the FIR petitioners and other accused persons made indiscriminate firing killing brother of the deceased and they were demanding rangdari.

Submission of the learned counsel for the petitioners is that in a recent development, anoother co-accused person has been arrested he has confessed his guilt and stated that he has fired on the deceased as such the petitioners have falsely been

Patna High Court CR. MISC. No.62714 of 2019(3) dt.05-11-2019 2/2 implicated in this case and they have no criminal antecedent also. On the other hand the informant has opposed the prayer for bail on the ground that the petitioner are named in the FIR and other witnesses during the investigation have also supported the prosecution case and named these accused persons also. Heard learned A.P.P. also.

Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant privilege of anticipatory bail to the petitioner, however, the petitioner is directed to surrender before the learned court below and make prayer for regular bail.

With the aforesaid direction, this application is dismissed.
