1. The Writ petition is filed to direct the respondents to return the recovered excessive amount of education loan from the petitioner which is not permissible as per the Draft Letter sent to the education loan borrowers dated 06.02.2010 and further seeks relief to direct the respondents to return the recovered excessive loan amount of the petitioner as per the Government Interest Subsidy Scheme for Economically Weaker Section

Patna High Court CWJC No.5990 of 2017(4) dt.24-06-2025 2/3 (EWS) and Draft Letter sent to education loan borrowers dated 06.12.2010 by State Bank of India, Jamalpur (Gogri) Khagaria. The 2nd relief sought in the Writ petition is to direct the respondents to return the excessive amount of Rs.2,94,843/-. Further to direct the respondents to pay the cost of the suit for compelling the petitioner to file this Writ petition and return the amount with interest.

2. Heard the Learned counsel for the petitioner as well as the Learned counsel for the respondents.

3. On perusal of the entire record, it is evident that it is purely a civil dispute between the Respondent Nos. 3 to 5 (respondent-Bank) and the petitioner, therefore, the Writ petition is not maintainable.

4. At this juncture, the Learned counsel for the petitioner intends to withdraw the Writ petition with a liberty to approach before the appropriate forum.

Accordingly, the Writ petition is

Patna High Court CWJC No.5990 of 2017(4) dt.24-06-2025 3/3 dismissed as withdrawn giving liberty to the petitioner to approach before an appropriate forum.
