2. The petitioner seeks bail in a case registered for the offences punishable under Sections 272, 273, 34 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2022.

3. Learned counsel for the petitioner submits that petitioner is a person with seven antecedent and allegation is of recovery of 45 litres of illicit liquor from an orchard.

4. Learned counsel for the petitioner submits that petitioner was not arrested from the spot as such nothing was recovered from his conscious possession and the orchard belongs to the petitioner but then no prudent person would use his own orchard for committing an occurrence and thus would

Patna High Court CR. MISC. No.69819 of 2024(2) dt.04-10-2024 2/2 create evidence against himself. It is further submitted that it appears that someone inimical to the petitioner and his family planted meager amount of liquor with an intention to implicate him and his family member.

5. Learned A.P.P. for the State opposes the prayer for bail of the petitioner.

6. Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, be released on bail on furnishing bail bonds of Rs. 15,000/- (Rupees Fifteen Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Jaynagar P.S. Case No. 76 of 2024.
