05-02-2020 Heard learned counsel for the parties.

The petitioners apprehend their arrest in Makhdumpur P.S. Case No. 269 of 2019 registered for the offence under Sections 304(B), 323, 328, 34 of the Indian Penal Code. It is case of dowry death of informant's daughter due to non-fulfillment of demand of dowry and petitioners are inlaws members of the deceased. It is submitted on behalf of petitioners that petitioner no. 1 is married nanad, petitioner no. 2 & 5 are brother-in-law

Patna High Court CR. MISC. No.61569 of 2019(4) dt.05-02-2020 2/3 (devar), petitioner no. 3 is gotini and petitioner no. 4 is elder brother-in-law (bhaisur) of the deceased and allegation of demand of dowry is against husband of the deceased. It is further submitted that there is no specific allegation against petitioners. Moreover, these petitioners have nothing to do with the affairs of the deceased, since they are living separately. In fact, later on, the informant has filed a petition that in view of some confusion, the present case has been lodged. It is further submitted that mother-in-law of the deceased namely Chando Devi has already been granted bail by this Court, vide order dated 18-11-2019 passed in Cr.Misc. No. 69081 of 2019.

In view of aforesaid facts & circumstances as well as nature of accusation, in the event of arrest or surrender within a period of six weeks from today, let the above named petitioners be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Jehanabad in connection with Makhdumpur P.S. Case No.

"(1) Petitioners shall cooperate in the trial and shall be properly represented on each and every date fixed by the Court and shall remain physically present, as directed by the Court and on their absence on two consecutive dates without sufficient reason, their bail-bond shall be cancelled by the Court below.

(2) If the petitioners tamper with the evidence or the witnesses, in that case, the prosecution will be at liberty to move for cancellation of bail."
