The petitioner apprehends his arrest in connection with Fatuha P.S. Case No.103 of 2019, registered under Section 147, 148, 149, 341 and 302 of the Indian Penal Code and Section 27 of the Arms Act.

The accusation is that ten persons named in the F.I.R. including the petitioner surrounded to Manoranjan Paswan, brother of the informant, Amarnath Paswan, at the door of his uncle, Somi Paswan in course of returning to his house. At that time, on the order of Jairam Paswan (petitioner), Chote Paswan fired through pistol at the head of Manoranjan Paswan, brother of the informant, who died on spot.

No.60443 of 2019(2) dt.24-09-2019 2/2 Learned counsel for the petitioner submits that petitioner is Choukidar and at the time of occurrence, he was on duty but with ulterior motive the petitioner has also been implicated in the present case with allegation of giving order by the petitioner, on which, Chotu Paswan, shot fire at the head of Manoranjan Paswan. The petitioner has no criminal antecedent. Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-V, Patna City, Patna, in connection with Fatuha P.S. Case No.103 of 2019, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
