Petitioners seek bail in a case registered under Sections 304B, 201/34 of Indian Penal Code.

Petitioners are Devar and father-in-law respectively of the victim. It is submitted that the informant (mother-in-law of victim) has implicated the entire family members merely on the basis of suspicion. There is no specific details as to what offence has been committed by these two petitioners and the petitioners are having no criminal antecedent. Petitioners are in custody since 20.06.2019.

Learned APP for the State has opposed the prayer.

Patna High Court CR. MISC. No.60331 of 2019(3) dt.11-12-2019 2/2 Considering the rival submissions, this Court is inclined to accept the submission of petitioner's counsel. Let the petitioner above named be released on bail on his furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate I, Begusarai in Birpur Police Station Case No 131 of 2018 subject to the following conditions:

(1) That one of the bailors will be a close relative of the petitioners who will give an affidavit giving genealogy as to how he is related with the petitioners. The bailor will also undertake to inform the Court if there is any change in the address of the petitioners.

(2) That the petitioners will be well represented on each date and if they fail to do so on two consecutive dates, their bail will be liable to be cancelled.
