The petitioner apprehends his arrest in connection with Tekari P.S. Case No.66 of 2021 registered under Sections 323, 324, 341, 308, 504, 506 and 379 of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has been implicated in this case due to previous enmity. The petitioner has got no criminal antecedent.
Learned A.P.P. for the State vehemently opposed the prayer for bail of the petitioner stating that there is a direct allegation of assaulting with sharp cut weapon on the head of the informant causing head injury which is corroborated by the
Patna High Court CR. MISC. No.65122 of 2022(2) dt.11-01-2023 2/2 injury report. Therefore, the petitioner does not deserve anticipatory bail.
Having considered the above facts and circumstances of the case as well as nature of allegation made against the petitioner as well as the injury report, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, his prayer for bail is rejected.
