The petitioner seeks bail in connection with Deoriya P.S. Case No.14/2010 registered for the offence punishable under Section 395 of the IPC.
Allegation as per FIR is that informant Shiv Sagar Mahto, Deoriya P.S. Case No.14/2010 has been lodged on 18.02.2010 against 10-12 unknown offenders u/s 395 IPC for the alleged occurrence of dated 17.02.2010 at 01:00 am in the night at village Ram Chandrapur. It has been inter alia alleged that all the offenders committed dacoity in the house of informant, his brother Sambhu Mahto and his neighbour Ramjanam Mahto and they took away various articles which include cash, ornaments, utensils, cloths, mobile phones etc. Learned counsel for the petitioner submits that
Patna High Court CR. MISC. No.62054 of 2019(4) dt.20-11-2019 2/2 petitioner has falsely been implicated in this case and no incriminating article has been recovered from the possession of the petitioner. Learned counsel for the petitioner further submits that no T.I. Parade has held and petitioner is in custody since 19.06.2019. Learned counsel for the petitioner submits that charge sheet has been submitted.
In the facts and circumstances of the case, let the petitioner above named be released on bail after framing of charge on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned ADJ, XIVth, Muzaffarpur in connection with Deoriya P.S. Case No.14/2010.
This bail application stands disposed of.
