JUSTICE BIRENDRA KUMAR ORAL ORDER 13-04-2017 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.

The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 341/323/307/504/379/34 of the Indian Penal Code. There is general and omnibus allegation of commission of assault by the petitioners as well as commission of theft for land dispute. Though allegation of commission of injury at the head of the informant is also there, however, allegation is not specific against the petitioners.

Considering the aforesaid facts, let petitioners, above named, in the event of their arrest or surrender before the Court

Patna High Court Cr.Misc. No.17477 of 2017 (2) dt.13-04-2017 2/2 below within a period of thirty days from the date of receipt of the order, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Sherghati, Gaya/Successor Court in connection with Barachati Police Station Case No.405 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. With further condition that petitioners shall fully cooperate with the investigation and trial of the case, failing which the Court-below shall be at liberty to take steps for cancellation of the bail-bonds of the petitioners in this case.
