2. The petitioner has preferred this application for grant of regular bail in connection with Chakia P.S. Case No. 386 of 2020 arising out of G.R. No. 8842/2020 dated 01.12.2020 registered for the offences punishable u/ss 379 and 411 of the Indian Penal Code.

3. As per the prosecution case, the petitioner and the co-accused person are alleged to have tried to steal the motorcycle of the informant.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. The name of the petitioner has sprung up in the

Patna High Court CR. MISC. No.76470 of 2024(3) dt.16-04-2025 2/3 confessional statement of the co-accused person. Nothing has been recovered from the conscious possession of the petitioner. The petitioner has no concern with the alleged offence. The petitioner has 13 criminal antecedents as stated in para 3 of the bail petition. The petitioner is in custody since 12.06.2024.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner and submitted that the anticipatory bail of the petitioner was earlier rejected by a Coordinate Bench of this court vide order dated 20.12.2022 passed in Cr. Misc. No. 55883 of 2022.

6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, East Champaran at Motihari in connection with Chakia P.S. Case No. 386 of 2020 arising out of G.R. No. 8842/2020.

7. The application stands allowed.
