JUSTICE VINOD KUMAR SINHA ORAL ORDER 16-10-2019 This application, for grant of anticipatory bail, arises out of Ishipur Barahat P.S. Case No. 113 of 2018, disclosing offences under Sections 341, 323, 354(B), 452 of the Indian Penal Code and Section 08 of the POCSO Act.
Allegation against the petitioner and his father is of assaulting the informant and others causing injury to them. Submission of learned counsel for the petitioners is that there is delay in lodging the F.I.R. and though there is allegation of assault, injuries caused to the informant and others were found simple in nature.
Heard learned A.P.P. also.
Having heard both sides, considering the facts and circumstances, this application is allowed. Let the petitioner,
Patna High Court CR. MISC. No.64656 of 2019(2) dt.16-10-2019 2/2 above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional District & Sessions Judge 1st -cum-Special Judge, POCSO Act, Bhagalpur, in connection with Ishipur Barahat P.S.
