JUSTICE CHANDRA PRAKASH SINGH ORAL ORDER 20-03-2023 Learned counsel for the petitioners is permitted to remove defect (s), as pointed out by the office, if any, within a period of four weeks on resumption of physical mode. Heard learned counsel for the petitioners and learned APP for the State.

The petitioners have preferred this application for grant of regular bail in a case registered under section 302, 201 and 304B read with section 34 of the Indian Penal Code. As per the prosecution case, the petitioners and coaccused persons are alleged to have committed murder of the daughter of the informant due to non-fulfillment of Rs. 5 lakhs as dowry.

Learned counsel for the petitioners has submitted that

There is general and omnibus allegation against the petitioners. The petitioner no. 1 is the cousin father-in-law of the deceased and the petitioner no. 2 is the brother-in-law of the deceased. Similarly situated co-accused has already been granted bail by the co-ordinate bench vide order dated 01.06.2020 passed in Cr. Misc. No. 82735 of 2019. The petitioners have clean antecedent as stated in para 3 of the bail petition. The petitioners are in custody since 13.06.2022 and 02.07.2022 respectively.

Learned A.P.P. for the State has opposed the bail petition of the petitioners.

Considering the aforesaid facts and circumstances, the petitioners above-named, are directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned court concerned Gaya, in connection with Tekari (Panchanpur) P.S. Case No. 195 of 2019.

The application stands allowed.
