The petitioner seeks bail in connection with Chhapra (Mufashil) P.S. Case No. 291 of 2019 (Special Case No. 21 of 2019) for the offence under Sections 420, 409, 120B of the Indian Penal Code and Section 13(1)(a) and 13(2) of the Prevention of Corruption Act, 1988. Learned counsel appearing for the petitioner submits that the petitioner, who is of clean antecedent, is innocent and has not committed any offence. In fact, the name of this petitioner has transpired in this case merely on the basis of confessional statement of the co-accused,
Patna High Court CR. MISC. No.60176 of 2019(3) dt.15-11-2019 2/2 Himanshu Rai and except confession nothing is on record against the petitioner and he is rotting in judicial custody since 28.07.2019.
Considering the facts and circumstances of the case, let the, above named, petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge Vigilance, North Bihar, Muzaffarpur in connection with Chapra (Mufashil) P.S. Case No. 291 of 2019 (Special Case No. 21 of 2019).
