2. The petitioners are in custody in connection with Surajgarha (Manikpur) P.S Case No. 374 of 2022 registered for the offences punishable under Sections 147, 148, 149, 341, 323, 325, 307, 504, 506 of the Indian Penal Code and Section 27 of the Arms Act.

3. As per the prosecution case, six named accused persons, including the petitioners herein, as well as eight to ten unknown accused persons, are said to have come variously armed with hocky sticks, lathi

Patna High Court CR. MISC. No.74416 of 2023(4) dt.21-02-2024 2/3 and iron rods. It is stated that the petitioners and one another took out their pistol and started to threaten the informant.

4. Learned counsel for the petitioners submits that petitioners have falsely been implicated in this case. He further submits that the other co-accused Dilip Mahto has been granted bail by a coordinate bench of the Court vide order dated 11.10.2023 in Cr. Misc. No. 64282 of 2023. It is also submitted that petitioners are in judicial custody since 17.07.2023.

5. However, learned APP for the State oppose the prayer for regular bail of the petitioners.

6. On perusal of the FIR, impugned order and period of custody and also considering the aforesaid facts and circumstances of the case and submissions made on behalf of the petitioners, let the above named petitioners be released on bail, on furnishing bail bonds of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Lakhisarai in connection with Surajgarha
