The petitioner seeks regular bail in connection with Rajauli PS case no. 190 of 2018 registered for the offence punishable under Sections 420, 467, 468, 471, 472/34 of Indian Penal Code.
The allegation is regarding recovery of a huge quantity of illicit liquor from a truck and the petitioner is said to have been caught from the spot.
The learned counsel for the petitioner submits that admittedly, the petitioner is the khalasi of the truck, hence he had no knowledge about the alleged liquor being carried in the truck and the truck also does not belong to the petitioner herein. It is further submitted that the petitioner has a clean
Patna High Court Cr.Misc. No.68135 of 2018(5) dt.21-01-2019 2/2 antecedent and is languishing in custody since 19.06.2018. Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular bail.
Accordingly, the abovenamed petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-II-cum-Special Judge, Nawada in connection with Rajauli PS case no. 190 of 2018.
