JUSTICE VINOD KUMAR SINHA ORAL ORDER 24-09-2019 This is an application for grant of anticipatory bail in connection with Gamhariya P. S. Case No. 39 of 2018, disclosing offences under Sections 302, 307, 325, 323, 341, 504, 506, 34 of IPC.

As per F.I.R. there is allegation that petitioner and other accused persons came and assaulted to the informant and allegation of assault against other accused person to the deceased as well as informant and name of the petitioner also transpires. It further appears that police after investigation submitted final form against the petitioner, but cognizance has been taken by the learned Magistrate, also.

Submission of the learned counsel for the petitioner is that he has falsely been implicated in this case and the final

Patna High Court CR. MISC. No.60248 of 2019(2) dt.24-09-2019 2/2 form has been submitted by the police after investigation. He has no criminal antecedent.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, surrender before the court below within a period of two weeks from the date of receipt of certified copy of this order, he will be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned C.J.M., Madhepura, in connection with Gamhariya P. S. Case No. 39 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure with condition that he has to co-operate in the trial.
