JUSTICE VINOD KUMAR SINHA ORAL ORDER 25-09-2019 This is an application for grant of anticipatory bail in connection with Roshanganj (Bankey Bazar) P. S. Case No. 160 of 2019, disclosing offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

As per F.I.R. one Bolero vehicle was intercepted and more than 600 liters of liquor has been recovered and arrested accused persons has disclosed the name of one Sanjay Gupta and of the petitioner as the salesman of the shop at Nawadiha Bazar.

Submission of the learned counsel for the petitioner is that there are allegation against the petitioner that the accused persons have taken the liquor from the shop of the petitioner and there is no other allegation against the petitioner. There is no allegation of transporting or supplying the liquor against the

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned Special Judge Excise Judge, Gaya, in connection with Roshanganj (Bankey Bazar) P. S. Case No. 160 of 2019, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
