JUSTICE KISHORE KUMAR MANDAL ORAL ORDER 19-07-2016 Heard the counsel for the petitioner and the State. Even according to the petitioner, the land on which the private respondent is making attempts to possess the government land recorded as such in the revenue records. In a representative capacity, the writ application is filed for a direction to protect the interest of the people at large in respect of the subject land appertaining to plot nos. 470,471, located in village Kotwa, under Gopalganj Anchal in the District of Gopalganj. In para-7, it has been stated as under:- 7.That, recently the Respondent No.6 with some anti social elements tried to stop the use of the said
Patna High Court CWJC No.24914 of 2013 (2) dt.19-07-2016 2/2 pokhara but due to the heavy protest by the villagers they were chased away and the villagers including the petitioner gave a petition to the Respondent No.3 on 11.7.2013 with a prayer to protect the interest of the villagers but nothing has been done."
An issue like this cannot be considered and resolved by this Court in exercise of its discretionary writ jurisdiction. It is stated that a litigation in respect of the subject land is pending. The application, in my view, deserves to be disposed of permitting the petitioner to ventilate his grievance before the appropriate forum/authority/Court in accordance with law. I order accordingly.
