JUSTICE VINOD KUMAR SINHA ORAL ORDER 18-12-2018 Petitioner prays for bail in connection with Vaishali P.S.Case No. 111 of 2018 registered for the offence punishable under Sections 302, 201 and 34 of the Indian Penal Code. Prosecution case as per FIR is that dead body of brother of informant was found lying in the mango orchard and suspicion has been raised against the petitioner and one more person, who is brother-in-law (Saru) of the petitioner that they have killed the deceased.

Submission of learned counsel for the petitioner is that except suspicion there is nothing against the petitioner and he is in custody since 15.5.2018.

Heard learned APP also, who has opposed the prayer for bail on the ground that mother-in-law and brother-in-law of the deceased have stated during investigation that they have

Having heard both sides and in the facts and circumstances, let petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Vaishali at Hajipur, in connection with Vaishali P.S.Case No. 111 of 2018, subject to the condition that one of the bailors of the petitioner shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned.
