The petitioner apprehends his arrest in Khizar-Sarai P.S. Case No.47 of 2011 registered under Sections 304(B), 201 and 34 of the Indian Penal Code.

The informant alleged that he married his daughter with Ranjit Yadav, son of Suresh Yadav (petitioner) about five years ago and on account of non-fulfillment of demand of dowry, the accused persons killed his daughter on 16.04.2011. Learned counsel for the petitioner submits that the daughter of informant died during the course of treatment. The dead body of Indu Devi was received by her brother Vishwanath Kumar. The police after investigation submitted final form finding the case 'false' on 31.07.2011 but the learned court below took cognizance of the offence on 27.02.2016 against the

Having considered the facts aforesaid, the petitioner, above named, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. III, Gaya in connection with Khizar-Sarai P.S. Case No.47 of 2011, subject to conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
