2. This is an application for regular bail on behalf of the petitioner for the offences alleged under Sections 413, 414/34 of the Indian Penal Code, registered in connection with Govindganj P.S. Case No. 253 of 2024.

3. As per prosecution case, there has been recovery of B.S.N.L. company's wire from a truck. The allegation against the co-accused persons is that they were loading the wire in the alleged truck. Accordingly, the F.I.R.

4. The learned Counsel for the petitioner has submitted that the petitioner is innocent and he is a person of clean antecedent. Further submission is that the driver, Ranjan Giri who was arrested at the spot has disclosed the names of accused persons but even in the statement of Ranjan Giri, the name of the petitioner has not figured, he is in custody since

5. Learned APP for the State has opposed the prayer of bail.

6. Considering the above facts and circumstances of the case as well as petitioner has clean antecedent, let the petitioner, above-named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-VII, East Champaran, Motihari in connection with Govindganj P.S. Case No. 253 of 2024, subject to the condition that the petitioner shall co-operate in the disposal of trial and make himself available as and when required by the Court. (i) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.

(ii) The learned Court below shall verify the criminal antecedent of the petitoner.
