2. The petitioner seeks regular bail in connection with Madhepura S. T. No. 184 of 2023, Purari P.S. Case No. 13 of 2023 dated 22.01.2023, lodged under Sections 302 and 34 of the I.P.C. and Section 27 of the Arms Act.

3. As per the prosecution case, the son of the informant was killed in a firing by the unknown accused persons.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He submits that the name of the petitioner and others were suspected on participating in the killing, as earlier also they had tried to kill the deceased. He further submits that no material has come to connect the petitioner with the alleged crime.

5. Learned counsel for the petitioner further submits that the co-accused Uttam Singh has been granted bail by the Co-ordinate Bench of this Court vide order dated 13.09.2023 passed in Cr. Misc. 54465 of 2023. He further submits that the petitioner is in custody since 01.03.2023.

6. Learned A.P.P. for the State opposes the prayer for bail.

7. Considering the facts and circumstances of the case, this bail application is allowed.

8. Let the petitioner above named, be granted bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge- 2nd, Madhepura in connection with S. T. No. 184 of 2023, Puraini P.S. Case No. 13 of 2023, subject to the conditions that the petitioner shall support in trial and shall appear physically either himself or through his lawyer before the lower court on each and every date fixed. In case of non-appearance for two consecutive dates without sufficient cause, shall be resulted into cancellation of his bail bond.
