This application is filed for modification of order dated 25.01.2021 passed in Cr. Misc. No. 28052 of 2020. Learned counsel appearing on behalf of the petitioner submits that the petitioner has been granted anticipatory bail on 25.01.2021 passed in Cr. Misc. No. 28052 of 2020 with a direction to surrender before the Court below within six weeks from today, the petitioner be released on bail upon furnishing bail bonds of Rs. 25000/- (twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-cum-Special Judge, State Excise,

Patna High Court CR. MISC. No.7632 of 2023(3) dt.27-02-2023 2/2 East Champaran at Motihari in Excise Case No. 195 of 2020, but due to some unavoidable circumstances, the petitioner could not surrender before the Court below within the stipulated time. In view of the matter, let the time to surrender of the petitioner, as ordered on 25.01.2021 passed in Cr. Misc. No. 28052 of 2020, be further extended by four weeks from today. Accordingly, the modification application is allowed and the order dated 25.01.2021 passed in Cr. Misc. No. 28052 of 2020 is modified to the above extent.
