2. The petitioner is in custody in connection with Fatehpur P.S. Case No. 67 of 2022 for the offence registered under Sections 147, 148, 149, 341, 323, 326 and 307 of the Indian Penal Code and Section 27 of the Arms Act lodged on 17.02.2022 by the informant, Raghu Yadav.

3. As per the prosecution story, the allegation is that the informant was going on his motorcycle to his house, when the accused persons intercepted and after abusing, they assaulted and specific allegation against this petitioner is of opening fire causing injury in informant's stomach. The further allegation is that it was not a single assault rather this petitioner twice fired, the first bullet missed thereafter he opened second fire which hit the informant's stomach.

4. Learned counsel for the petitioner submits that he has already been suffered by being in custody since 08.08.2024, if granted relief, he shall be diligently appearing in trial.

5. Learned APP opposes the prayer submitting that he opened fire.

6. Taking into account the fact that he has remained in custody since 08.08.2024, an undertaking has been given that he shall be diligently appearing in trial, in that background, this Court is inclined to extend him the privilege of bail with conditions.

Let the petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of like amount each to the satisfaction of learned ACJM-X, Gaya or concerned Court, in connection with Fatehpur P.S. Case No. 67 of 2022 subject to the following conditions: (i) one of the bailor should be the family member/relative of the petitioner who shall provide official document to show his bona fide;

(ii) the petitioner shall appear on each and every date before the Trial Court and failure to do so for two consecutive dates without plausible reason will entail cancellation of his bail bond by the Trial Court itself;

(iv) the petitioner shall in no way try to induce or promise or threat the witnesses or tamper with the evidences, failing which the State shall be at liberty to take steps for cancellation of the bail bonds;

(v) the petitioner shall desist from committing any criminal offence again, failing which the State shall be at liberty to take steps for cancellation of his bail bonds. (Rajiv Roy, J) Ravi/- U T
