The petitioner is languishing in custody for the offence punishable under Section 306/34 of the Indian Penal Code.
Petitioner is husband of the victim of dowry death. He is in custody since 06.07.2018. Marriage of the petitioner with deceased was solemnized in the year 2013. Allegation is that from April, 2018 onwards there was demand of dowry and torture for the same. As a result whereof victim was throttled to death.
Submission is that during investigation the witness stated before the police that parties had entered into a love
Patna High Court CR. MISC. No.68883 of 2018(3) dt.12-04-2019 2/2 marriage, when the victim went to her parent's house, they refused to allow her entry and being frustrated of that she committed suicide.
Considering the conflicting material on the record, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Courtbelow where the case is pending in connection with Bihariganj P.S. Case No. 109 of 2018, with following conditions: (a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.
(b) The petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner. (Birendra Kumar, J) Banti/Rajan U T
