The petitioner seeks regular bail in connection with Singheshwar P.S. Case No. 02 of 2017 registered for the offence punishable under Sections 379 of the Indian Penal Code. The allegation in the present case is regarding tractor of the informant having been stolen from the house of the informant and the same could not be traced out. However, subsequently, the same was recovered while it was parked by the side of a road in front of the brick-kiln of one Mithilesh Yadav.

Learned counsel for the petitioner submits that barring the criminal antecedent of the petitioner, there is no reason to keep the petitioner in custody in the present case in as much as

Patna High Court Cr.Misc. No.70500 of 2018(3) dt.10-01-2019 2/2 neither any recovery has been made from the petitioner nor there is any evidence against the petitioner to connect him with the alleged crime.

Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular bail.

Accordingly, the abovenamed petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Madhepura, in connection with Singheshwar P.S. Case No. 02 of 2017.
