The petitioners have filed the instant application for grant of regular bail in a case registered for the offences punishable under Sections 341, 323, 337, 307, 504, 506/34 of the Indian Penal Code.

The allegation against the petitioners and other co-accused persons is that they assaulted the informant by means of butt of revolver due to which he sustained

It is submitted by learned counsel for the petitioners that the petitioners are innocent and they have committed no offence. They have falsely been implicated in the present case. There is land dispute between the parties. Both parties are neighbors and they have inimical terms. Moreover, the petitioners are languishing in judicial custody since 18.08.2022. A statement has been made in para 3 of the petition that petitioners have no criminal antecedent.

Learned APP appearing for the State and learned counsel for the informant have vehemently opposed the prayer for Bail.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case, this Court is inclined to enlarge the petitioners on bail. The above named petitioners are directed to be enlarged on bail in connection with Bachhawara P.S. Case No. 206 of 2022
