The petitioners seek regular bail in connection with Haspura PS case no. 183 of 2018 registered for the offence punishable under Sections 302/120B Indian Penal Code. The case of the prosecution is that when the father of the informant was missing from the house, the informant i.e. the son of the deceased has searched his father, whereafter the dead body of the father of the informant was found lying in mud in the farm of Shivpati Yadav and on mere suspicion, on the ground that the petitioner and other accused persons used to threaten the informant and his father, had implicated the petitioners and other accused persons falsely.

No.69310 of 2018(3) dt.09-01-2019 2/2 The learned counsel for the petitioners has submitted that the petitioners have been implicated in the present case merely on suspicion and there is no material in the case diary to show the complicity of the petitioners herein in the alleged death of the father of the informant whereas the death of the father of the informant cannot be ruled out on account of him falling down. It is further submitted that the petitioners are having clean antecedents and they are languishing in custody since 04.10.2018.

Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioners on regular bail.

Accordingly, the abovenamed petitioners are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Aurangabad in connection with Haspura PS case no. 183 of 2018.
