1. Heard learned counsel for the petitioners and learned A.P.P. for the State.

2. The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 147, 149, 341, 323, 353, 188 and 504 of the Indian Penal Code as well as Sections 3 and 4 of the Prevention of Damage to Public Property Act, 1984.

3. Learned counsel for the petitioners submits that petitioners are persons with clean antecedent and are husband and wife. It is further submitted that co-accused, namely, Harendra Prasad @ Harendra Chaudhary and two others had approached this Court seeking anticipatory bail by filing Cr. Misc. No. 41418 of 2024 and the same was allowed by an order

Patna High Court CR. MISC. No.68769 of 2024(2) dt.24-01-2025 2/2 dated 11.07.2024. It is next submitted that case of the petitioners, if not akin, is similar to the case of Harendra Prasad @ Harendra Chaudhary and others, thus, seeks the same privilege based on parity.

4. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.

5. Considering the submissions made by the learned counsel for the petitioners, let the petitioners above-named, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Bidupur P.S. Case No. 104 of 2024, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
