====================================================== CORAM: HONOURABLE MR. JUSTICE SUNIL DUTTA MISHRA ORAL ORDER 15-11-2025 Heard learned counsel for the petitioners and learned APP for the State.
2. Petitioners seek regular bail in connection with Bijdhari P.S. Case No.73 of 2025 registered for the alleged offences punishable under Sections 115(2), 126(2), 127(2), 352, 351(2)(3), 309(4) of the B.N.S., 2023.
3. As per prosecution case, the allegation against the petitioners is that they chased the pickup van of the informant and forcibly taken Rs.4,500/- from his pocket and also abused him.
4. Learned counsel for the petitioners submits that the
Patna High Court CR. MISC. No.64602 of 2025(3) dt.15-11-2025 2/3 petitioners are innocent and have falsely been implicated in this case. He further submits that due to taking side there was some hot talk exchange between driver of pickup van and the petitioners and with malafide, the informant lodged the F.I.R. against the petitioners. Learned counsel submits that both the parties have compromised and in this regard filed a petition before the learned Trial Court. He further submits that petitioners are in custody since 09.07.2025, petitioner no.1 has one criminal antecedent of Excise Act and petitioner nos.2 & 3 have got clean antecedent. Learned counsel submits that charge sheet had already been submitted in this case after completion of investigation. He further submits that there is no likelihood of absconding the petitioners or tampering with the evidence and they undertake to cooperate in the trial of the case.
5. Learned APP for the State opposes the prayer for grant of bail to the petitioners.
6. Considering the submissions made on behalf of the parties, facts and circumstances of the case and the period of custody, let the petitioners, named above, be enlarged on bail upon furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, East
