2. Petitioner apprehends his arrest in a case registered for the offence punishable under sections 103 (1) and 3 (5) of BNS.
3 . As per the prosecution case , informant namely, Sheela Devi alleged that on 14.03.2025 , on the eve of holi festival, this petitioner threw garbage from his home which led to maarpeet in which husband of informant died.
4. It is submitted on behalf of the petitioner that both the parties are neighbours and due to petty dispute , this petitioner has falsely been implicated in this case . Informant is not an eye witness to the alleged occurrence . Only suspicion has been raised against this petitioner. As per postmortem
Patna High Court CR. MISC. No.65420 of 2025(3) dt.07-11-2025 2/2 report, no injury was found on the body of deceased rather cause of death is due to Intra Cranial Haemorrhage . Petitioner is Government employee and is driver in Jehanabad Sadar Hospital. F.I.R. was lodged after delay of 8 days of the alleged occurrence for which there is no explanation which itself creates doubt over the entire prosecution case . Petitioner claims clean antecedent.
5 . Learned counsel for the State as well as informant opposed the bail petition .
6 Considering the aforesaid facts, postmortem report, delay in lodging the F.I.R. clean antecedent of the petitioner and other circumstances of the case , in the event of arrest or surrender within eight weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned chm Arwal in connection with Kinjar P.S. Case No. 54 of 2025 , subject to the conditions laid down under section 482(2) of the Bharatiya Nagarik Suraksha Sanhita , 2023 .
