JUSTICE VINOD KUMAR SINHA ORAL ORDER 25-09-2019 This is an application for grant of anticipatory bail in connection with Complaint Case No. 791 of 2017, disclosing offences under Section 498A of the Indian Penal Code and Section 4 of Dowry Prohibition Act.

Petitioner happens to be the husband of the complainant and working at Metro Railway, at Kerala, whereas as per the submission, complainant is working in the Bajaj company. Allegation against the petitioner and other accused persons is of demand of dowry, for that, torturing her. Submission of learned counsel for the petitioner is that the whole allegation is false and concocted and he is still ready to keep her with full dignity and care, unless she comes to

Heard learned APP as well as learned counsel for the opposite party no.2, who has no objection in residing with the petitioner, unless she is allowed to live with full dignity and care.

In view of the stand of both the parties, this application is disposed of with a direction to the petitioner to surrender before the learned court below on 04.11.2019 and on that day, the opposite party no.2 shall also remain present in the Court and further on filing of an affidavit by the petitioner that he is ready to keep her with full dignity and care and to take her from the Court itself, the petitioner shall be released on provisional bail for a period of 06 months. It is also made clear that the learned court below shall also see as to whether the opposite party no.2 is ready to reside with the petitioner at his working place or continue to work at Delhi and ready to reside with petitioner, whenever she gets time. Further the learned court below shall also call upon both the parties after expiry of six months and once the court below is satisfied with the conduct of both the parties, and their marital relationship, especially the conduct of the petitioner, the court below shall confirm the bail bonds of the petitioner, otherwise pass any
