Heard learned counsel for the petitioners and learned A.P.P. for the State.

The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 307, 323, 341, 379, 447, 504, 506 and 34 of the Indian Penal Code. 3.
Learned counsel for the petitioners submits that the petitioners have antecedent of one case and Petitioner Nos. 1 and 2 are women and the informant alleges that on 3-4-2024 he was at home when the accused persons including the petitioners came and started abusing and threatened to withdraw the case, on protest, Keshaav assaulted him by butt of the pistol on head

No.70494 of 2024(2) dt.03-10-2024 2/3 causing injury, thereafter all the accused persons assaulted his brother, namely Balender Prasad Singh, by Kudali causing injury and Rani tried to press the private parts of his brother, while Aman snatched his golden chain and petitioners took out Rs. 20,000/-.

The learned counsel for the petitioners submits that petitioners have been falsely implicated in the instant case by the informant. It is next submitted that no doubt petitioners have antecedent of one case but then the complaint case has been instituted under Sections 323 and 504 of the IPC, it is also submitted that even presuming what has been alleged is true without admitting then the petitioners are not alleged to have assaulted but then it is submitted that allegation of snatching Rs. 20,000/- is ornamental. It is further submitted that it does not appear probable that Rani would have tried to press the private parts of the informant's brother.

Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.

Considering the submissions made by the learned counsel for the petitioners, the petitioners above-named, in the event of their arrest or surrender before the learned trial court within a period of six weeks from today, be released on
Patna High Court CR. MISC. No.70494 of 2024(2) dt.03-10-2024 3/3 anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Matihani P.S. Case No. 47 of 2024, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
