JUSTICE SANDEEP KUMAR ORAL ORDER 12-02-2025 Heard learned counsel for the petitioner and learned APP for the State Shri Jharkhandi Upadhyay, who has filed counter affidavit in this case and the same is taken on record.

2. This is the second attempt of the petitioner for grant of regular bail in connection with Adhaura P.S. Case No. 53 of 2023 registered for the offence under Sections 8©, 20(b) (ii)(c), 22, 27A of the NDPS Act.

3. As per the prosecution case, 38.5 kg of Ganja has been recovered from the possession of the petitioner.

4. It has very fairly been submitted by the learned counsel for the petitioner that the trial has started and out of five charge-sheeted witnesses, two have already been examined.

5. Considering the fact that the recovery is of

Patna High Court CR. MISC. No.70979 of 2024(3) dt.12-02-2025 2/2 commercial quantity and also considering the fact that the trial of the petitioner has started, this Court is not inclined to grant bail to the petitioner.

6. Accordingly, this application is dismissed.

7. The Court below is directed to conclude the trial at the earliest.
