The petitioner seeks regular bail in connection with Sherghati P.S.Case no.43 of 2018 dated 31.1.2018 registered for offences punishable under Sections 328, 302/34 of the Indian Penal Code.

Allegation against the petitioner who happens to be father of the deceased is that he administered poison to his daughter causing her death.

Submission of the learned counsel for the petitioner is that after the investigation the charge sheet has been submitted under Section 306 of the IPC. He is in custody for about one year and informant is the first wife of the petitioner. Heard learned A.P.P. also.

Patna High Court Cr.Misc. No.72784 of 2018(4) dt.16-01-2019 2/2 Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge IX, Gaya in connection with Sessions Trial No.39 of 2018 arising out of Sherghati P.S.Case no.43 of 2018with condition to co-operate in the disposal of the trial otherwise his bail bond shall be cancelled..

With the aforesaid observation, this application is allowed.
