The petitioner is in custody in connection with Alamnagar (Ratwara O.P.) P.S. Case No. 167 of 2018 for the offence under Section 302/34 of the Indian Penal Code and Section 27 of the Arms Act.

Learned counsel for the petitioner would submit that petitioner has no criminal antecedent. Learned counsel for the petitioner further submits that there is no eye witness to the firing on the victim.

In this case diary was called for. Learned APP appearing on behalf of the State with reference to case diary would submit that informant has claimed that she has seen the petitioner and other coaccused fleeing away from the place of occurrence.
