The petitioner seeks bail in connection with Ramgarhwa P.S. Case No. 250 of 2017 instituted for the offence under Section(s) 341/323/307/504/34 of the Indian Penal Code and Sections 25(1-b)a/26/27/35 of the Arms Act. Learned counsel for the petitioner submits that petitioner is not named in the FIR. It has further been submitted that injured has claimed himself to be an eye-witness of this case. He has not taken the name of this petitioner. Although, he has taken the name of other accused persons.

The statement of injured is recorded in para 18 of the case diary, wherein, he has taken the name of this petitioner

Patna High Court Cr.Misc. No.69704 of 2018(4) dt.17-12-2018 2/2 levelling allegation against the petitioner along with other accused persons made firing causing injury to him. Injury report is available in the case diary, wherein, doctor has found injuries to be simple in nature. It has further been submitted that other co-accused of this case has already been granted regular bail by co-ordinate Bench of this court vide order dated 06.12.2018 passed in Criminal Misc. No. 71461 of 2018.

Petitioner is in custody since 04.09.2018.

Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Raxaul at Motihari, East Champaran in connection with Ramgarhwa P.S. Case No. 250 of 2017, subject to the condition that both the bailers shall be the close relative of the petitioner.
