2. The petitioner is apprehending his arrest in connection with Muffasil P.S. Case No. 343 of 2020 registered for the offences punishable under Section 379 of IPC.
3. As per prosecution case, the answer sheet of petitioner namely, Satyam Kumar, was missing and the case has been lodged on the ground that petitioner is the person who is responsible for disappearance of an answer sheet.
4. Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence as alleged in the FIR and he has falsely been implicated in this case. Petitioner bears no criminal antecedent. Learned counsel for the petitioner submits that invigilator for saving his skin has lodged case against the petitioner. No.64650 of 2025(2) dt.17-09-2025 2/3 17 includes the answer sheet and attendance sheet of the petitioner, which clearly indicate that the petitioner did not abscond during the examination conducted by the concerned authority. He was present at the examination centre throughout, and therefore, there is no question of the petitioner taking away the answer sheet from the examination hall. Petitioner has explained why he has approached this court for taking anticipatory bail as FIR was instituted on 16.12.2020 and on verification of roll no. , the investigating officer got verification report mentioning therein that bearing Roll No.
1415240076 was issued for the candidate namely Satyam Raushan (petitioner) and the petitioner has no knowledge about institution of the aforementioned case which was lodged against him. After verification, the I.O informed family member of the petitioner about institution of aforementioned case. Thereafter, the petitioner preferred anticipatory bail before the learned trial court. The allegation of theft of question paper is totally false fabricated and concocted as it is evident from the enclosure of the documents in the FIR which proves that petitioner after completion of the examination submitted his answer sheet and then he left the examination hall. In the light of aforesaid facts and circumstances, no offence is made out against the petitioner. Apart from that, petitioner bears no criminal antecedent.
5. The learned A.P.P. for the State vehemently opposes the prayer for anticipatory bail of the petitioner and submits that there is specific allegation against the petitioner who is said to have taken

Considering the facts and circumstances of the case, keeping in view clean antecedent of petitioner, argument advanced on behalf of both sides and also taking into consideration the material available on record, the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Nawada in connection with Muffasil P.S. Case No. 343 of 2020, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Alok Kumar Pandey, J) vashudha/- U T
