Earlier, vide order dated 08.12.2021 passed in Cr.Misc. No. 55759 of 2021, the prayer for anticipatory bail of petitioner and one another has been dismissed as withdrawn. Learned counsel for the petitioner submits that earlier, due to mistake on his part, the anticipatory bail petition of petitioner was withdrawn, since the Court was functioning in virtual mode. He submits that husband of the informant has already been granted anticipatory bail by a coordinate Bench of this Court, vide order dated 16.11.2022 passed in Cr. Misc. No. 31190 of 2022. He further submits that petitioner is cousin Devar (brother-in-law) of the informant and he has got no concern with family affairs of couple. He is separate in mess & property and has got clean antecedent.

Let the above named petitioner, in the event of arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Nalanda at Biharsharif in connection with Mahila (Nalanda) P.S. Case No. 42 of 2021, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
