JUSTICE VIKASH JAIN ORAL ORDER 29-06-2020 Heard learned counsel for the petitioner, learned counsel for the Economic Offence Unit as well as learned APP for the State through video conference.

2. This is the 4th attempt of the petitioner for grant of bail, who is in custody since 17.09.2016 in connection with Special Case No. 67 of 2016, arising out of Economic Offence P.S. Case No. 12 of 2016 for the offences alleged under Sections 8, 20(b)(ii)(c), 25 and 29 of the NDPS Act and Sections 420, 467, 468 and 471 of the Indian Penal Code having earlier been rejected thrice by this Court by order dated 21.08.2017 in Cr. Misc. No. 33206 of 2017, by order dated 14.03.2018 in Cr. Misc. No. 58162 of 2017 and by order dated 27.02.2019 in Cr. Misc.

3. It is submitted that the petitioner has been falsely implicated in connection with recovery of 182 Kg of Ganja from a Bolero car of which the petitioner is said to be the driver. It is submitted that the petitioner is admittedly not the owner of the vehicle and as driver, he was not aware about the nature of the goods as he was merely driving the vehicle on instruction of his master. It is further submitted that the petitioner has no concern with the offending goods recovered from the vehicle. The petitioner claims clean antecedents.

4. Learned APP assisted by learned counsel for the Economic Offence Unit appear and have been heard.

5. Be that as it may and having regard to the period of custody already suffered since 17.09.2016, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of like amount each to the satisfaction of learned Additional District Judge-XX, Patna, in connection with Special Case No. 67 of 2016 arising out of Economic Offence P.S. Case No. 12 of 2016, if he is not otherwise required in any other case.
