The petitioners apprehend their arrest in connection with G.O Case No. 212A of 2006 (G.O 849 of 2015), registered under Sections 379, 413 and 427 of the Indian Penal Code.

The accusation is that 12 persons named in the F.I.R. including the petitioners cut the Sisam tree from Gairmazarua Aam land.

Learned counsel for the petitioners submits that petitioners have falsely been implicated in this case mere on suspicion. Further submission is that similarly situated co-

No.74911 of 2018(5) dt.22-05-2019 2/2 accused Mithilesh Kumar @ Mithilesh Singh has already been granted privilege of pre-arrest bail by a co-ordinate Bench of this Court on 10.01.2019 vide Criminal Miscellaneous No. 183 of 2019. The petitioners have no criminal antecedent. Having regard to the facts and circumstances of the case, let the above named petitioners, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the S.D.J.M., Nawada in connection with G.O. Case No. 212A of 2018 (G.O 849 of 2015), subject to the condition as laid down under Section 438

(2) of the Cr.P.C.
