The matter has been listed under the heading "For Orders" under the orders of Hon'ble the Chief Justice. Heard learned counsel for the petitioner and the State. The explanation, so called for, from the trial court is accepted.
The petitioner seeks bail in a case registered for the offence under Sections 302, 120(B)/34 of the Indian Penal Code and 27 of the Arms Act.
Earlier prayer for bail of the petitioner was rejected vide Annexure-1 to the present application with liberty to renew her prayer for bail if no substantive progress is made in the trial. It is a case where the petitioner is said to be the first
Patna High Court CR. MISC. No.61571 of 2019(7) dt.21-09-2020 2/2 wife of the deceased and with a view to inherit the whole property, she killed her husband, second wife of her husband and their two sons. Altogether four persons are said to have been murdered. As per postmortem report, the death caused due to fire-arm injury.
Considering the nature of the case, I am not inclined to grant bail to the petitioner. Accordingly, prayed for bail of the petitioner in connection with Dumra P.S. Case No. 210 of 2018 giving rise to Sessions Trial No. 03 of 2019 is rejected. However, the trial court is directed to take all necessary steps to conclude the trial preferably within a period of nine months from the date of restoration of normalcy.
