2. Learned Counsel for the State submits that the present matter is related to contractual appointment for one year and during pendency of the writ petition, about 8 years has already been lapsed. He further submits that the matter becomes infructuous due to the reason that no one is present on behalf of the petitioner.

Counsel for the State further submits that in paragraph 12 of the counter-affidavit, a clear cut stand has been taken by the State that the Bihar Lab Technicians Cadre Rules, 2014 has been framed and duly notified by the Health Department, Government of Bihar and selection process has been started.

4. In this view of the matter, it transpires to this Court that the present writ petition has become infructuous. Even if the petitioner found that there is some points left in this case, then he shall be at liberty to revive the same.
