Petitioner seeks bail in Jagdishpur (Goradih) P.S. Case No. 4/18 registered for the offence under Section 304 (B), 34 of the Indian Penal Code.
Allegation against the petitioner who happens to be the husband of the deceased, is of killing the daughter of the informant due to non-fulfillment of dowry demand. Submission on behalf of the learned counsel for the petitioner is that nothing specific has been attributed to the petitioner and he has himself surrendered in the court below and he is in custody since 31.05.2018 having no criminal antecedent. Heard the learned A.P.P. also. who opposed the prayer for bail of the petitioner stating that the post mortem report shows
Patna High Court Cr.Misc. No.63057 of 2018 (3) dt.02-11-2018 2/2 that there were three ante mortem injuries on the person of the deceased and that the cause of death was asphyxia and shock due to smothering.
Having heard both sides and in view of the facts and circumstances of the case, stated above, I am not inclined to grant bail to the petitioner. Prayer for bail of the petitioner is rejected. This application is, accordingly, dismissed.
