JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 09-01-2019 Heard learned counsel for the petitioners and counsel appearing on behalf of the State as well as informant. The petitioners are in custody in connection with Agamkuan P.S. Case No. 503 of 2018 for the offence under Sections 420/385/471 of the Indian Penal Code and Section 66 ( C) (E)/67 of I.T. Act.
Learned counsel for the petitioner submits that petitioners are in custody since 13.8.2018 and 09.08.2018 respectively.
Considering the background that the petitioner and informant were made friend on facebook and thereafter their friendship led to the commission of the present offence of
Patna High Court Cr.Misc. No.71141 of 2018(5) dt.09-01-2019 2/2 alleged extortion. The Court is in the fact situation is of the view that when the investigation has been complete in the instant case there is no justification to keep the petitioners in custody. The court is inclined to enlarge the petitioners on bail, let the petitioners named above, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, I, Patna City, in connection with Agamkuan P.S. Case No. 503 of 2018. (Anil Kumar Upadhyay, J) T.Kr./- U T
