This application has been filed for restoration of CWJC No. 4903 of 2015 which was dismissed for want of prosecution vide order dated 10.01.2017.
It is submitted by learned counsel for the petitioner that during pendency of the application the petitioner has already died. It is further contended that in view of the changed circumstance the application for restoration may be disposed of
Patna High Court MJC No.917 of 2017(3) dt.05-02-2020 2/2 with liberty to the heirs and dependents of the deceased petitioner Mohan Lal Das to file another writ petition in the same subject matter as raised by the deceased petitioner in CWJC No. 4903 of 2015.
In view of the submission made above, the instant application has become infructuous as the petitioner is no more. Since it is a restoration application, no further order need be passed.
However, if so advised, the dependents and legal heirs of the deceased petitioner may proceed with the matter in accordance with law.
