The petitioner seeks regular bail in connection with Bachhwara Rail P.S.Case no.08 of 2019 registered for offences punishable under Sections 302 & 201/34 of the Indian Penal Code.
Dead body of the deceased was found and the petitioner and other accused persons are named on suspicion. Submission of the learned counsel for the petitioner is that no incriminating materials has been found against the petitioner and only on suspicion he has been made accused and considering the same the co-accused has been granted bail by a Co-ordinate Bench of this Court, vide order dated 29.8.2019
Patna High Court CR. MISC. No.62246 of 2019(3) dt.06-02-2020 2/2 passed in Cr. Misc. No.82844 of 2019. Petitioner is in custody since 1.4.2019.
Heard learned A.P.P. also.
Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Railway Judicial Magistrate, Barauni (Begusarai) in connection with Bachhwara Rail P.S.Case No.08 of 2019..
With the above direction, this application is allowed.
